Nel lontano ottobre 2003 essendo da anni responsabile del servizio di prevenzione e protezione presso la Direzione Generale per il Patrimonio Storico artistico del Ministero per i Beni e le Attività Culturali del Museo Nazionale delle Arti e Tradizioni Popolari, ho richiesto di partecipare al 1° Master “Tutela salute e sicurezza nei luoghi di lavoro” organizzato dalla SSPA e nonostante fossi tra i più qualificati dei richiedenti venni escluso.
Il numero dei partecipanti fu ridotto dai 100 previsti a soli 60 ed io fui escluso in quanto qualificato al 66 posto.
Il paradosso è stato che la SSPA, di fronte alle mie rimostranze, in un primo tempo addirittura, ha tentato d’impedirmi l’accesso agli atti ai sensi della 241.
Non riuscendo a capacitarmi circa i motivi della mia esclusione, avevo addirittura pensato che la commissione si fosse risentita quando ho sollevato la perplessità (che non aveva nulla di ostile o irrispettoso) sulla durata del corso di ben 262 ore, che mi appariva eccessiva to the subject matter, compared to 120 hours of the course for the 494.

the exclusion measure the arch. De Girolamo from the Master "Protection of the Health and Safety in the workplace," a circular issued by the Director of SSPA No 6970 August 26, 2003, and all acts connected with or consequential condition.

1. The architect De Girolamo, an official in area "C", Head of the Prevention and Security at the Directorate General for the Historic Art of the Ministry of Heritage and Culture National Museum of Popular Arts and Traditions, states that it first applied to participate in the Master "Protecting health and safety in the workplace", in the circular of Direttore della S.S.P.A. n. 6970 del 26 agosto 2003.
Ai fini dell’ammissione, era previsto lo svolgimento di una selezione, basata sul curriculum ed un colloquio individuale, nel corso del quale i candidati avrebbero avuto modo di manifestare “le specifiche attitudini e competenze professionali ovvero

le motivazioni personali di interesse alla frequenza del corso”.
In data 29.10.2003 la scuola comunicava all’arch. De Girolamo, che, in base ai criteri individuati dalla Commissione incaricata dello svolgimento della selezione, egli si era classificato al 66° posto della graduatoria, e, pertanto, essendo stato previsto un numero massimo di 60 allievi, era stato escluso dalla partecipazione al master.
Dopo avere ottenuto il parziale soddisfacimento delle proprie istanze di accesso, il ricorrente proponeva il presente ricorso, in particolare deducendo:
1) Violazione e mancata applicazione dell’art. 3, comma 1, della l. n. 241 del 1990. Violazione degli artt. 3, 24, 97 e 113 Cost.. Eccesso di potere per difetto di istruttoria e di motivazione. Violazione dei generali principi di par condicio tra i candidati. Disparità di trattamento. Ingiustizia manifesta. Sviamento di potere. Illogicità e irrazionalità manifesta.
La Commissione esaminatrice non ha predeterminato alcun criterio di valutazione, come risulta dal verbale n. 1 della sua riunione preliminare.

3. The merits of the appeal is based.
notes that the Board, nel verbale relativo alla riunione preliminare della Commissione, non vi è indicazione alcuna in ordine ai criteri di selezione delle candidature bensì un mero richiamo agli elementi di giudizio (curriculum e colloquio) che, a tal fine, sarebbero stai considerati, nonché al punteggio massimo attribuibile.
Detti criteri non sono rinvenibili nemmeno nella circolare con cui è stata diffusa l’iniziativa formativa curata dalla Scuola, come pure gli stessi non possono, sic et simpliciter, essere desunti dalla mission alla stessa affidata.
Tale ultimo assunto sembra invece sotteso alla relazione di chiarimenti versata in atti, in cui il Direttore della Scuola rappresenta che, in realtà, il giudizio espresso sui candidati non is a "final assessment of their skills and professional skills, tending rather to identify the effectiveness of the training course compared to the individual and the needs of the organization in which he works. "It happens so - it adds in the report - that are positively selected candidates less prepared on the subject, but for which it is believed that the frequency of the course plus the knowledge that gives effect to the functions which are or will be applied."

So even in this case, whatever the ultimate aim of the selection (purely educational, or merit), or the circular indict, nor the examining board have made explicit selection criteria, thus making it transparent without meaning assigned to the numerical coefficients evaluation of the curriculum and the interview "motivational".

UIL,DA CONSIGLIO SUPERIORE VOTO ARTICOLATO E 'PALETTI' (ANSA) - ROMA, 4 DIC - Il parere del consiglio superiore dei beni culturali alla bozza di riforma del ministero e' stato articolato e votato in quattro diversi punti. Lo rende noto la Uil Beni culturali, sottolineando che il consiglio ha di fatto anche posto dei 'paletti' proprio sul termine 'valorizzazione' che deve essere intesa come prevede il Codice all'articolo 6 , ovvero valorizzazione in senso culturale dei beni per la promozione e la conoscenza, non per la mercificazione . Il primo punto - al quale sono andati 11 voti favorevoli ed 1 astenuto - riguardava l'apprezzamento della scelta fatta da Bondi di riportare all'attenzione del consiglio il testo riformulato della bozza di riforma del ministero. Il secondo punto riguardava la nuova formulazione della direzione generale per la valorizzazione: in questo caso i voti a favore sono stati 8, mentre hanno votato contro in tre: Marisa Dalai Emiliani, Mariella Guercio e Gianfranco Cerasoli. Nel terzo punto messo ai voti il consiglio conferma pero' al di la' della riformulazione dell'articolo sulla nuova direzione generale, tutte le critiche espresse nel voto del 18 novembre : in questo caso ci sono stati 11 voti a favore e 1 astenuto. Infine al quarto punto - votato all'unanimita' - il documento stilato dal consiglio superiore denuncia la situazione di sofferenza e grave disagio delle sedi periferiche del ministero, soprintendenze, archivi, biblioteche. Tra le cose da apprezzare, sottolinea il rappresentante dei sindacati Cerasoli (che ha votato contro la nuova direzione ed espresso un giudizio negativo sull'intero schema di regolamento) il metodo usato dal ministro, che ha garantito che una volta approvato il decreto da Consiglio dei Ministri della prossima settimana durante la discussione che si terra' davanti alle Commissioni Parlamentari di Camera e Senato ''sara' costantemente monitorato e potra' essere oggetto di ulteriori approfondimenti da parte del Consiglio Superiore''.
